It equates to about $6 a fortnight.However, the credit cards are another kettle of fish altogether. Daria Verfaillie: I believe that Federal Agencies are the only ones who can garnish your Disability check. Things like Child Support, Back Taxes and Student Loans. But, I don't think that private creditors can access your disability for garnishment. Check with a professional to be sure. There's always the option of Bankruptcy to stop these creditors from making your life more difficult. Rashad Marecki: Private lenders of credit cards cannot garnish public benefits like social security. However, if you default on a government debt, they definitely can garnish your be! nefits up to 15% a month unless it is SSI. They may also take ! the money when you get your next tax refund. Credit card companies cannot directly take your money that may not be social security if you have other money, they have to file a lawsuit, win a judgment, then the court would decide.
